موريتانيا : دعوة للمجلس الدستوري للنظر فى مدى شرعية استدعاء الحكومة للناخبين
أنباء انفو- وجه زعيم المعارضة الديمقراطية فى موريتانيا اليوم الثلاثاء 30 ماي 2017 دعوة إلى المجلس الدستوري طالبه فيها ، النظر في دستورية استدعاء الحكومة الناخبين لاستفتاء 15 يوليو المقبل.
الدعوة التى تضمنها بيان صحفي للهيئة ، جاءت ردا على مصادقة مجلس الوزراء في اجتماعه الطارئ يوم أمس الإثنين على مرسوم استدعاء الناخبين.
وهذا نص بيان هيئة المعارضة الديمقراطية:

يشكل استدعاء الحكومة لهيئة الناخبين استمرارا لمسار أحادي يستهتر بالقيم الديمقراطية، ويتنكر لمقتضيات الشراكة الوطنية، من أبرز تجلياته حوار مجتزأ منظم حسب المقاس والمزاج، قاطعته أبرز القوى السياسية المعارضة والفعاليات الاجتماعية الجادة، فلم يكن شاملا ولا جادا ولم يزد الساحة السياسية إلا تشرذما وانقساما.
رغم عدم جدية الحوار المذكور، ورغم تكريسه للأزمة السياسية فقد واصل النظام الهروب إلى الأمام والمضي قدما في تنفيذ أجندته الأحادية ونتائجه الهزيلة، من خلال القفز على المسطرة القانونية السليمة التي توجها الشيوخ برفض مخرجات هذا الحوار وطي صفحتها من الوجهة الدستورية السليمة باتفاق جميع الخبراء والمختصين.
لكن عناد النظام واستخفافه بالقوانين والقيم الديمقراطية كان وراء تعلقه بإعمال المادة 38 من الدستور بشكل متعسف ومبتسر، وهو ما رفضه أغلب الخبراء والمختصين في مجال القانون الدستوري، وأدانته معظم القوى السياسية في البلاد، فكان من نتائج إعمال المادة 38 اللجوء إلى الاستفتاء المباشر لإقرار التعديلات الدستورية المقترحة، تلك التعديلات التي تفتقد مواصفات الإلحاح والأهمية والجدوائية، وتكرس الفرقة والأزمة والعبث بالدستور.
يشكل مرسوم استدعاء هيئة الناخبين خرقا لأحكام الدستور الموريتاني، لتأسيسه على مقتضيات دستورية تأسيسا خاطئا ومخالفا لترتيبات الدستور المتعلقة بالتعديل الدستوري، وتصرفا أحاديا سيزيد الوضع السياسي تعقيدا وتأزما.
بناء على الترتيبات الدستورية المشار إليها، ومراعاة لدقة الوضع السياسي، واستشعارا لخطورة تعميق الأزمة السياسية وتكريس الفرقة.
فإنـــــــني أدعـــــــــــو:
الحكومة الموريتانية للتعقل والتروي والتراجع فورا عن استدعاء هيئة الناخبين لاستفتاء 15 يوليو 2017، وتوقيف هذا المسار الأحادي الذي يفرق ولا يجمع.
المجلس الدستوري لتحمل مسؤوليته تجاه حماية الدستور وتكريس المطابقة والحكم بعدم دستورية هذا المرسوم المؤسس على أحكام مخالفة لآليات التعديل المحدد في الدستور الموريتاني.
الحكومة وجميع القوى السياسية للتداعي لحوار جدي يتفق على تنظيمه ومضمونه يفضي لحل الأزمة السياسية وتجاوز الإشكالات العالقة على جميع المستويات السياسية والاجتماعية والاقتصادية.
